In particular, we use Google Analytics (provided by Google LLC and, for users from the United Kingdom or European Economic Area, Google Ireland Limited) to help us understand how visitors interact with our Website and to improve the performance, content, and user experience of our Services. Google Analytics collects certain information automatically, such as your device type, browser information, operating system, IP address, approximate location, pages viewed, time spent on pages, and interactions with website features.
Google Analytics uses cookies and similar technologies to recognize your browser or device and to collect this information. Where required by applicable law (such as under the GDPR in the UK/EEA), we only activate Google Analytics after you have provided consent through our cookie banner or settings tool. We implement IP anonymization for Google Analytics where supported, so that your IP address is shortened before it is stored or processed by Google.
Google uses the information collected through Google Analytics to provide us aggregated reports and insights. Google may also process this information as a data controller where it uses it for its own purposes, as described in Google’s privacy policies.

e. Direct Marketing

When you create an account to utilize our Services our download the App, you will receive marketing communications from us. You will also automatically opt in to our marketing communications if you have requested information from us or purchased goods or Services from us. Our Services necessarily involve using your personal information to contact you about our own and third-parties’ goods and services that may be of interest to you.
We may also analyze your Identity Data, Contact Data, Technical Data, Usage Data, and/or Profile Data to form a perspective regarding which of our products, Services, and other offers may be of interest to you so that we can then send you relevant marketing communications.
Further, we may use the personal data we have collected from you to enable us to display advertisements to our advertisers’ target audiences. Please note we will get your express consent before we share your personal data with any third party for their own direct marketing purposes. Even though we do not disclose your personal information for these purposes without your consent, if you click on or otherwise interact with an advertisement, the advertiser may assume that you meet its target criteria.
You can opt out of our marketing communications at any time by sending us an email with your request to contact@adventurtle.com. If you opt out of receiving marketing communications, you will still receive Services-related communications that are essential for administrative or customer service purposes.

We are based in the state of Michigan in the United States. We provide the Services for use only be persons located in the countries and geographic regions specifically listed in our terms of use (https://www.adventurtle.com/terms-of-use).
Whenever we transfer your personal data outside of the United States to countries which have laws that do not provide the same level of data protect as the United States, we always ensure that a similar or increased (where applicable) degree of protection is afforded to it.
We will only transfer your personal information to countries that we have determined provide an adequate level of protection for personal data in accordance with that country’s applicable laws. For instance, if your data is transferred to a country that has implemented the GDPR, we will ensure that appropriate safeguards are in place to protect your personal information and that it receives a level of protection consistent with the requirements of the GDPR.

8. Data Security

We have implemented measures designed to secure your personal information from accidental loss and from unauthorized access, use, alteration, and disclosure. In addition, we limit access to your personal data to those employees, agents, contractors, and other third parties who have a business need to know. They will only process your personal information on our instructions, and they are subject to a duty of confidentiality.
The safety and security of your information also depends on you. Where we have given you (or where you have chosen) a password for access to certain parts of our Services, you are responsible for keeping this password confidential. We ask you not to share your password with anyone. We urge you to be careful about giving out information in public areas of the Services like message boards. The information you share in public areas may be viewed by any user of the Services.
Unfortunately, the transmission of information via the internet is not completely secure. Although we do our best to protect your personal information, we cannot guarantee the security of your personal information transmitted to our Services. Any transmission of personal information is at your own risk. We are not responsible for circumvention of any privacy settings or security measures contained on the Services.
Please note we have put in place procedures to deal with any suspected personal data breach and will notify you and any applicable regulator of a breach where we are legally required to do so under applicable law.

9. Data Retention

We will only retain your personal data for as long as reasonably necessary to fulfil the purposes we collected it for, including for the purposes of satisfying any legal, regulatory, tax, accounting, or reporting requirements. We may retain your personal information for a longer period in the event of a complaint or if we reasonably believe there is a prospect of litigation in respect to our relationship with you.
We retain Google Analytics data in accordance with the retention settings available within Google Analytics and only for as long as necessary to fulfill the purposes described in this privacy policy. To determine the appropriate retention period for personal data, we consider the amount, nature, and sensitivity of the personal data; the potential risk of harm from unauthorized use or disclosure of your personal data; the purposes for which we process your personal information and whether we can achieve those purposes through other means; and the applicable legal, regulatory, tax, accounting, or other requirements.
Depending on your country of residence, under applicable law, we may have to keep basic information about you as a customer (including your Contact Data, Identity Data, Financial Data, and Transaction Data) for six years after you cease being a customer for tax purposes.

10. Your Legal Rights

a. United States Customers (Excluding California)
​
If you are located in the United States, depending on your state of residency, you may have certain rights related to your personal data, including:

Access and Data Portability. You may confirm whether we process your personal data and access a copy of the personal data we process. To the extent feasible and required by state law, depending on your state, data will be provided in a portable format. Depending on your state, you may have the right to receive additional information and it will be included in the response to your access request.

Correction. You may request that we correct inaccuracies in your personal data that we maintain, taking into account the information’s nature and processing purpose.

Deletion. You may request that we delete personal data about you that we maintain, subject to certain exceptions under applicable law.

Opt Out of Using Personal Data for Targeted Advertising, Profiling, and Sales. You may request that we do not use your personal data for these purposes, if applicable.
The exact scope of these rights vary by state. There are also several exceptions where we may not have an obligation to fulfill your request.
Some browsers and browser extensions support the Global Privacy Control (“GPC”) that can send a signal to process your request to opt out from certain types of data processing, including data “sales” as defined under certain laws. When we detect such a signal, we will make reasonable efforts to respect your choices indicated by a GPC setting as required by applicable law.
Nevada provides its residents with a limited right to opt out of certain personal data sales. Residents who wish to exercise their sales opt out rights may submit a request to us at the information provided in the Contact Details section below. However, please know we do not currently sell data triggering that statute’s opt out requirements.

b. California Customers

If you are a California resident, the California Consumer Privacy Act (“CCPA”) grants you the following rights regarding your personal information:

Right to Know and Data Portability Requests. You have the right to request that we disclose certain information to you about our collection and use of your personal information, including the specific pieces of personal information we have collected about you (a “data portability request”). You may exercise your right to know twice in any 12-month period. Once we receive your request and confirm your identity, we will disclose to you: the categories of personal data we collected about you and the sources from which we collected your personal information; the business or commercial purpose for collecting your personal data and, if applicable, selling or sharing your personal information; if applicable, the categories of persons, including third parties, to whom we disclosed your personal data, including separate disclosures identifying the categories of your personal information that we disclosed for a business purpose to each category of persons; and/or sold or shared to each category of third parties; and when your right to know submission includes a data portability request, a copy of your personal information, subject to any permitted redactions.

Right to Delete. You have the right to request that we delete any of your personal data that we collected from you and retained, subject to certain exceptions and limitations. Once we receive your request and confirm your identity, we will delete your personal data from our systems unless an exception allows us to retain it. We will also notify our service providers, contractors, and other recipients to take appropriate action.

Right to Correct. You have the right to request correction of personal information we maintain about you that you believe is inaccurate. We may require you to provide documentation, if needed, to confirm your identity and support your claim that the information is inaccurate. Unless an exception applies, we will correct personal information that our review determines is inaccurate and notify our service providers, contractors, and other recipients to take appropriate action.

Right to Limit Sensitive Personal Information (“SPI”) Use and Disclosure to Permitted SPI Purposes. You have a right to ask businesses that use or disclose your sensitive personal information to limit those actions to just the CCPA’s Permitted SPI Purposes. Once we receive your valid request, we will limit the use and disclosure of your sensitive personal information to the Permitted SPI Purposes. Personal Information Sales or Sharing Opt Out and Opt-In Rights. You have the right to request that businesses stop selling or sharing your personal data at any time, including through a user-enabled opt out preference signal. Similarly, the CCPA prohibits businesses from selling or sharing the personal information of consumers it actually knows are under 16 years old without first obtaining consent from consumers who are between 13 and 15 years old or the consumer’s parent or guardian for consumers under age 13. We cannot sell or share your personal information after we receive your request to opt out unless you later consent to the sale or sharing of your personal information.

ADMT Rights. When a business uses automated decision-making technology (“ADMT”) to make significant decisions about you, you may have rights to obtain certain information about how the business uses ADMT that is specific to you or you may opt out of the ADMT use unless the business provides you with a method to appeal the decision to a human reviewer with the authority to overturn the decision or another exception applies. ADMTs are technologies that process personal data and use computation to execute a decision and either replace or substantially replace human decision-making, resulting in decisions made without human involvement. Decisions are significant when they result in the provision or denial of financial or lending services, housing, education enrollment or opportunities, employment or independent contracting opportunities or compensation, or healthcare services. Advertising is not a significant decision. We do not currently use ADMT to make significant decisions about consumers, so we do not provide ADMT access, opt out, or appeal rights.

Right to Non-Discrimination. You have the right not to be discriminated or retaliated against for exercising any of your privacy rights under the CCPA.
c. Certain International Customers

If you are an international customer in certain other countries, you may have a number of rights under your country’s applicable data protection laws in relation to your personal data. You may have the right to:

Subject Access Request. You may have the right to request access to your personal data. This enables you to receive a copy of the personal data we hold about you and to check that we are lawfully processing it.

Correction Request. Under your country’s applicable data privacy laws, you may have the right to request correction of the personal information that we hold about you. This enables you to have any incomplete or inaccurate data we hold about you corrected, though we may need to verify the accuracy of the new data you provide to us.

Erasure Request. You may have the right to request erasure of your personal data in certain circumstances. This enables you to ask us to delete or remove personal information where there is no good reason for us continuing to process it. You also have the right to ask us to delete or remove your personal data where you have successfully exercised your right to object to processing (see below), where we may have processed your data unlawfully, or where we are required to erase your personal information to comply with local law. Note, however, that we may not always be able to comply with your request of erasure for specific legal reasons which will be notified to you, if applicable, at the time of your request.

Under your country’s applicable data privacy laws, you may have the right to object to our processing of your personal data where we are relying on a legitimate interest (or those of a third party) as the legal basis for that particular use of your personal information (including carrying out profiling based on our legitimate interests). In some cases, we may demonstrate that we have compelling legitimate grounds to process your information which may override your right to object. You also have the absolute right to object any time to the processing of your personal data for direct marketing purposes.

Consent Withdrawal. Depending on your country’s applicable data privacy laws, you may have the right to withdraw consent at any time where we are relying on consent to process your personal data. However, this will not affect the lawfulness of any processing carried out before you withdraw your consent. We try to respond to all legitimate requests within one month. Occasionally it could take us longer than a month if your request is particularly complex or you have made a number of requests. In this case, we will notify you and keep you updated.
